These Terms of Use (“Terms”) govern your access to and use of the TapFitFam, LLC website, https://www.tapfitfam.com, and any related websites, programs, memberships, digital products, content, and services operated by TapFitFam, LLC (the “Company,” “we,” or “us”) (collectively, the “Site”).
By accessing or using the Site, you agree to comply with and be bound by these Terms and all applicable laws and regulations. These Terms supersede any prior agreements between you and the Company relating to your use of the Site.

1. Content Ownership & Permitted Use
All content available on the Site, including but not limited to choreography, class structures, teaching methods, frameworks, videos, audio, downloads, written materials, graphics, images, branding, and design (collectively, the “Content”), is owned by TapFitFam, LLC or used with permission and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Content for personal or educational use only, subject to the permissions and restrictions outlined in these Terms.

2. Use by Dance Teachers & Studios
TapFitFam, LLC supports dance educators and encourages the use of its Content within in-person or private studio classes, provided that:
• The Content is not resold, redistributed, or republished
• The Content is not included in a competing paid digital program or membership
• The Content is not marketed or represented as original choreography created by the user

Permission Required
Prior written permission from TapFitFam, LLC is required if the Content or choreography is used for:
• Competitions
• Studio showcases promoted as original choreography
• Commercial performances
• Revenue-generating programs beyond standard class instruction
• Branded or recorded offerings intended for sale or distribution

3. Prohibited Use
You may not:
• Claim TapFitFam choreography, frameworks, or materials as your own original work
• Share login credentials or allow unauthorized access to paid Content
• Resell, sublicense, or redistribute Content in any format
• Use Content in a way that competes directly with the Company’s offerings
• Modify or create derivative works for commercial use without permission

4. Music Disclaimer
TapFitFam, LLC does not own or claim rights to any music used in classes, videos, or programs.
Music is used for educational and instructional purposes only. Any reuse of choreography, class recordings, or movement sequences that include music may require proper licensing from the applicable music rights holders.
Users are solely responsible for obtaining any necessary music licenses for public performances, competitions, recordings, or commercial use.

5. Accuracy of Information
The Company makes reasonable efforts to ensure that information on the Site is accurate and current but makes no warranties regarding completeness, reliability, or accuracy. Content is provided for educational and informational purposes only.

6. Accounts, Registration & Communications
When you create an account or purchase Content, you agree to provide accurate information and to maintain the security of your login credentials. You are responsible for all activity that occurs under your account.
By registering, you consent to receive electronic communications from the Company, including account notifications, service updates, and promotional messages. You may unsubscribe from marketing communications at any time.

7. User Submissions
Any feedback, comments, testimonials, suggestions, or other submissions you provide to the Company may be used by TapFitFam, LLC for business, educational, or promotional purposes without compensation to you.

8. Payments, Subscriptions & Refunds
All purchases, subscriptions, and payments are governed by the Company’s Refund Policy, which is incorporated into these Terms by reference.
Unless otherwise stated:
• All sales are final and non-refundable
• Subscriptions continue until canceled by the user
• Users are responsible for managing subscription cancellations through their account settings

The Company may, at its sole discretion, issue refunds as a courtesy without obligation.

9. Third-Party Platforms & Services
The Site is hosted on Kajabi, and payments may be processed through third-party providers. The Company is not responsible for interruptions, errors, or service failures caused by third-party platforms. Any such issues are governed by the third party’s terms.

10. Disclaimer of Warranties
THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
The Company does not guarantee:
• Specific results, outcomes, or success
• Fitness improvements or physical outcomes
• Business or income results
• Uninterrupted or error-free access to the Site

Your results depend on your individual effort, consistency, health, and circumstances.

11. Assumption of Risk
Participation in dance, movement, and fitness activities involves inherent risks. By using the Site and Content, you voluntarily assume all risks associated with physical activity and release TapFitFam, LLC from liability for injuries or damages.

12. Limitation of Liability
To the fullest extent permitted by law, TapFitFam, LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Content.

13. Indemnification

• Everything you see here — the classes, choreography, videos, and materials — is created to support your movement and learning. Please don’t copy, resell, or share paid content.
• Dance teachers are welcome to use TapFitFam content inside their own classes. If you’d like to use choreography for competitions, performances, recordings, or commercial projects, please reach out first so we can talk permission or licensing.
• All programs, memberships, and digital products are for personal or educational use, not for creating competing online programs.
• Music used in classes is for teaching purposes only. TapFitFam does not own the music, and you’re responsible for securing music rights if you reuse choreography publicly or commercially.
• Subscriptions continue until you cancel them through your account settings. Unless otherwise stated, purchases are non-refundable.
• Movement and fitness come with natural risks. Please listen to your body and participate at your own pace.
• We do our best to keep everything running smoothly, but we can’t promise the site will always be perfect or uninterrupted.
