Custom Service Agreement Template for 'Fitness 15' and TapFitFam Online Programs

1. Introduction

Parties Involved: This Service Agreement ("Agreement") is made and entered into on the date of enrollment, by and between Ashley Borromeo / TapFitFam ("Service Provider"), and the Client.

2. Services Provided

Description of Services: Service Provider agrees to perform the following services under 'Fitness 15' and all TapFitFam online programs:

  • Fitness 15: A unique blend of dance and traditional fitness elements designed to improve overall health and well-being.
  • TapFitFam Programs: Various online dance and fitness sessions tailored to different skill levels and goals.

3. Payment Terms

Fees and Payment Schedule:

  • Total Fee: $15 Monthly Recurring Subscription 
  • Payment Schedule: Free 2 Day Trial begins day of clicking "Complete my Purchase" button. 

4. Liability and Injury Waiver

Acknowledgment of Risk: Client acknowledges that participation in 'Fitness 15' and TapFitFam online programs involves inherent risks, including but not limited to physical injury. Client voluntarily assumes all risks associated with these activities.

Waiver of Liability: Client agrees to release, waive, discharge, and hold harmless the Service Provider from any claims, demands, or causes of action arising out of any loss, damage, or injury, including but not limited to personal injury, death, or property damage, while participating in these services.

5. Assumption of Risk

Client certifies that they are physically fit and have no medical conditions that would prevent full participation in the 'Fitness 15' and TapFitFam online programs. Client agrees to notify the Service Provider of any health issues that may arise.

6. Medical Treatment Consent

Client consents to receive medical treatment in the event of an injury, accident, or illness during participation in the 'Fitness 15' and TapFitFam online programs and agrees to indemnify and hold harmless the Service Provider for any costs or liability arising from such treatment.

7. Termination Clause

Conditions for Termination: Either party may terminate this Agreement with [Number] days written notice. In the event of termination, Client will be liable for payment of services rendered up to the termination date.

8. Governing Law

Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. Services are rendered online.

9. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings of any kind.

10. Acknowledgment and Agreement
